Given the Fifth Amendment protection against deprivations of life, liberty, and property without due process of law, procedural concerns are carefully analyzed in administrative law actions. However, administrative resolutions offer lower costs and more specialized actors compared to judicial offerings. At the same time, administrative rulings are challenged based on the authority of the agency deciding disputes. Total Gas & Power N. Am., Inc. v. FERC offers insight into the pros and cons of administrative resolutions.
